Agreement to Terms
By downloading, installing, or using Quietus ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.
Description of Service
Quietus is a professional-grade ambient sound generator that creates real-time parametric audio with binaural beats and journey automation. The App:
- Generates all sound mathematically in real-time — no pre-recorded loops
- Provides binaural beat generation for brainwave entrainment
- Offers time-based journey automation for evolving soundscapes
- Processes all audio locally on your device
- Works entirely offline with no internet connection required
Purchase and Payment
Free Trial
Quietus is free to download and offers a 7-day free trial starting from your first use of the App. During the trial, you have full access to all features with no limitations.
After the Trial
Once the 7-day trial ends, playback is limited to 5 minutes per session. All other features — preset creation, journey editing, sound design — remain accessible.
One-Time Purchase
Unlimited playback requires a one-time purchase of $12.99 USD (or equivalent in your local currency). This is a lifetime purchase:
- No subscription fees — pay once, own forever
- No recurring charges — your purchase never expires
- Unlimited playback — no session time limits
- All current features — full access to everything
- Future updates — included at no additional cost
Payment Processing
All purchases are processed through the Apple App Store. Moonquake Media does not collect, store, or have access to your payment information. Purchases are subject to Apple's App Store terms and conditions.
Refunds
Refund requests must be made through Apple. We do not process refunds directly. Visit Apple's support page for refund requests.
License Grant
Subject to your compliance with these Terms, Moonquake Media grants you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on devices you own or control
- Use the App for personal, non-commercial purposes
- Access and use features according to your purchase status
Restrictions
You agree NOT to:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices
- Use the App for any unlawful purpose
- Attempt to circumvent purchase verification
- Redistribute App assets, factory presets, or bundled content
- Use the App to infringe on others' intellectual property rights
Intellectual Property
Factory Presets
Factory presets bundled with the App are proprietary to Moonquake Media and may not be redistributed separately from the App.
User-Created Presets
You retain all rights to presets you create in Quietus. Your presets are your own and you may export, share, and distribute them as you wish.
AI-Generated Images
Images generated through the optional Apple Image Playground feature are subject to Apple's Image Playground terms of service. Moonquake Media does not claim ownership of AI-generated images created through this feature.
Your Content
Preset Ownership
You retain all rights to presets and sound configurations you create in Quietus. The App does not claim any ownership of your content.
Preset Sharing
When you export and share presets (.quietuspreset or .quietuspack files), you are responsible for ensuring you have the right to distribute any content included in those presets.
Local Processing
All audio generation and preset management occurs locally on your device. We do not access, store, or transmit your presets or configurations.
Health and Safety Disclaimers
Binaural Beats
Quietus generates binaural beats for relaxation, focus, and general wellness purposes. Binaural beats are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
- Binaural beats are presented for relaxation and focus purposes only
- They are not a substitute for professional medical treatment or advice
- If you have epilepsy, a seizure disorder, or any neurological condition, consult your physician before using binaural beats
- If you experience any discomfort, dizziness, or adverse effects, discontinue use immediately
Audio Safety
- Use appropriate volume levels, especially when using headphones
- Extended listening at high volumes may cause hearing damage
- The App includes a lookahead limiter for loudness protection, but users are responsible for setting safe listening levels
- Take regular breaks during extended listening sessions
Not Medical Advice
Audio generated by Quietus is for ambient sound, relaxation, and focus purposes. No claims are made regarding therapeutic, medical, or clinical efficacy. The App is provided as a sound generation tool, not as a medical or therapeutic device.
Disclaimers
"As Is" Provision
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of audio output
- Suitability for any particular health or wellness purpose
Audio Output
Real-time synthesized audio may vary based on device capabilities. The App is a sound generation tool and audio output characteristics may differ across devices and configurations.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Moonquake Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid for in-app purchases
- We are not liable for any loss of data, presets, or configurations
- We are not liable for any health effects from using binaural beats or audio generated by the App
Indemnification
You agree to indemnify and hold harmless Moonquake Media from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Presets or content you share or distribute
Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.
Termination
We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe:
- Violates these Terms
- Is harmful to other users
- Is harmful to our business interests
Governing Law
These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law provisions.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
